Terms of Service, Vehicle Care Authorization, Drop-Off, Transport, Storage, and Release Agreement

This agreement is intended to be signed before service begins and kept with the customer record.

This Client Service Agreement and Terms of Service governs all services performed by Eli's Elite Detailing LLC d/b/a Eli's Elite Mobile Detailing. It applies to mobile appointments, office drop-off appointments, transport to and from the shop, overnight vehicle storage, monthly maintenance services, specialty services, and any other vehicle care services unless a separate written agreement controls.

Section 01

Business Information and Service Area #

Eli's Elite Detailing LLC, doing business as Eli's Elite Mobile Detailing, provides professional vehicle detailing, maintenance cleaning, paint correction, ceramic coating, protective services, and related vehicle care services. Services are generally offered within a 30-mile radius of Birmingham, Alabama, unless the company agrees otherwise in writing.

Section 02

Acceptance of Agreement #

By booking, approving a quote, paying a deposit, signing this agreement, leaving a vehicle for service, providing a key, allowing access to a vehicle, or receiving service, the customer agrees to this agreement. The customer also represents that they are the owner, lessee, authorized driver, fleet manager, or otherwise legally authorized to approve service, access, movement, transport, and payment for the vehicle.

If the customer is signing for a business, fleet, family member, employer, spouse, co-owner, leaseholder, or other third party, the customer confirms they have full authority to bind that person or entity to this agreement.

Section 03

Services, Packages, and Pricing #

Services are offered through packages, add-ons, subscriptions, and custom quotes. Final scope depends on the package selected, the condition of the vehicle, the vehicle size, the quoted work, and any written service notes.

Ceramic coating, paint correction, odor treatment, biohazard work, severe pet hair removal, special stain removal, heavy contamination removal, wheel removal, headlight restoration, PPF, tint-related work, and other specialty services are not included unless specifically quoted and paid for. Add-ons may only be available with a package and may not be available as standalone services.

Section 04

Vehicle Size Selection and Price Corrections #

Customers are responsible for selecting the correct vehicle size when booking. Eli's Elite Mobile Detailing has the sole right to determine the final vehicle size classification. If the vehicle is booked under the wrong size, including Extra Large vehicles such as Transit vans, Sprinter vans, high-roof vans, extended vans, oversized fleet vehicles, or heavily modified vehicles, the price will be corrected to the proper size before service is completed or billed.

Customer approval is not required for a size correction. By booking, the customer agrees to pay the corrected price. Refusal to pay the corrected price may result in cancellation, forfeiture of the deposit, refusal to release the vehicle until the balance due is paid to the extent permitted by law, and refusal of future service.

Section 05

Quotes, Estimates, and Changes in Condition #

Quotes are based on the information available when the appointment is booked. Photos, descriptions, online forms, prior service history, package names, or verbal descriptions may not fully reveal the actual condition of a vehicle. If the vehicle condition is materially different than described, if excessive contamination is present, or if the requested result requires more work than the booked service includes, the company may recommend additional work, adjust the price, limit the scope, or refuse service.

Detailing improves the cosmetic condition of the vehicle. It does not guarantee restoration to new condition unless a specific restoration result is expressly quoted in writing. Stains, odors, scratches, oxidation, embedded contamination, etched water spots, pet hair, dye transfer, smoke odor, mold odor, and other defects may improve but are not guaranteed to be fully removed.

Section 06

Booking, Deposits, Cancellations, and No-Shows #

A deposit equal to twenty percent (20%) of the service total is required to reserve an appointment unless the company waives or changes the deposit in writing. Deposits are strictly non-refundable because they reserve labor, schedule capacity, travel, preparation time, and opportunity cost.

  • Cancellations or rescheduling requests made within 72 hours of the appointment may forfeit the deposit.
  • No-shows, inaccessible vehicles, locked vehicles, unavailable keys, unsafe conditions, customer absence when required, or refusal of corrected pricing may forfeit the deposit.
  • Deposits greater than 20% are treated as standard deposits unless a separate written agreement says otherwise.
  • If the company refuses or cancels service for reasons unrelated to customer breach, the company may refund the deposit less unrecoverable processing fees or offer rescheduling at its discretion.
Section 07

Weather and Rescheduling Policy #

Weather, temperature, wind, lightning, rain, pollen, construction dust, driveway conditions, and unsafe service conditions are evaluated solely by Eli's Elite Mobile Detailing. Weather is not a valid reason for customer cancellation or deposit refund. If the company determines that conditions are unsuitable, the appointment may be moved to the shop, rescheduled, modified, or completed under alternate conditions.

For subscription or maintenance services, weather rescheduling does not pause billing, move the billing cycle, create a free extra service, or roll unused service into another month unless the company agrees in writing.

Section 08

Payment Terms, Card on File, and Release of Vehicle #

Payment is due immediately upon completion unless a written agreement states otherwise. For office drop-off, shop service, overnight service, or any vehicle in the company's possession, payment is due before the vehicle is released. Card payment is preferred, and the customer authorizes the company to securely store a card on file where supported by the payment processor.

The customer authorizes Eli's Elite Mobile Detailing to charge the card on file for approved services, deposits, balances due, missed appointment fees, subscription charges, storage fees, travel fees, administrative fees, and other amounts owed under this agreement. The company may withhold release of the vehicle until payment is received to the extent permitted by law.

Layaway or installment options may be offered at the company's discretion. No service will be performed under a layaway arrangement until the service is paid in full unless the company agrees otherwise in writing. Failure to pay may result in collections, recovery of processing fees, administrative costs, storage fees, attorney fees, court costs, liens where permitted by law, and other legal remedies.

Section 09

Authorization to Access, Move, Operate, and Transport Vehicle #

The customer authorizes Eli's Elite Mobile Detailing, its owner, employees, contractors, and authorized representatives to access, unlock, lock, start, idle, steer, move, park, operate, and transport the vehicle as reasonably necessary to perform services, document condition, move the vehicle around the office, shop, driveway, lot, or service area, or transport the vehicle between the drop-off office, shop, storage area, and return location.

  • The customer confirms the vehicle is legally registered, insured, reasonably safe to operate, and has enough fuel or battery charge for movement and transport.
  • The customer must disclose mechanical issues, brake issues, steering issues, electrical issues, alarm issues, aftermarket modifications, immobilizers, battery problems, air suspension issues, leaks, known warning lights, or any condition that may affect safe movement.
  • The company is not responsible for mechanical, electrical, sensor, battery, tire, alignment, suspension, drivability, warning-light, or prior repair issues unless directly caused by the company's negligence.
  • If the vehicle cannot be safely moved, started, transported, parked, charged, or released, the customer is responsible for towing, roadside assistance, repair coordination, additional labor, storage, and related costs unless the issue was caused by the company's negligence.
Section 10

Office Drop-Off, Shop Service, Overnight Storage, and Pickup #

Some appointments may require the customer to drop the vehicle at the office, after which the company may detail the vehicle at its shop or another service location and return it to the office or agreed pickup location. The customer authorizes this process and understands that the vehicle may be parked, moved, stored, or transported before, during, and after service.

  • Customer must provide accurate drop-off and pickup instructions and must leave the correct key, key fob, access code, gate code, parking pass, charger access, or other required access items.
  • Customer should not leave house keys, unnecessary key rings, garage openers, cash, jewelry, firearms, documents, electronics, medication, toll devices, or valuables with the vehicle.
  • Vehicles left overnight are not intended for long-term storage. Unless otherwise agreed, the customer must pick up the vehicle within 24 hours after completion notice.
  • If a completed vehicle is not picked up within the required time, the company may charge storage of $50 per calendar day, beginning the day after pickup was requested, to the extent permitted by law.
  • The company may release the vehicle only to the customer or an authorized person. Identification, payment confirmation, or written authorization may be required before release.
  • Risk of theft, vandalism, weather, falling objects, acts of God, hit-and-run incidents, or third-party damage while parked or stored is not assumed by the company unless caused by the company's negligence.
Section 11

Customer Responsibilities Before Service #

The customer must prepare the vehicle and service area before appointment time. This keeps the job efficient, safe, and priced correctly.

  • Remove all personal belongings, trash, money, cards, electronics, child seats, booster seats, tools, work materials, documents, firearms, weapons, medication, illegal items, and valuables.
  • Provide safe and legal access to the vehicle, including enough room around the vehicle for equipment and technicians.
  • Obtain permission from property owners, employers, HOAs, apartment complexes, parking garages, security gates, or fleet managers when service occurs on property not owned by the customer.
  • Disclose biohazards, bodily fluids, vomit, feces, blood, mold, pest infestations, needles, sharp objects, weapons, dangerous materials, or any unusual condition before service begins.
  • Make sure the vehicle is available at the scheduled time and that the correct key is accessible.

A $75 personal item removal fee may apply if the company must remove, bag, sort, or work around excessive belongings, trash, car seats, work equipment, or loose items. The company may refuse service if the vehicle is not reasonably prepared.

Section 12

Personal Property, Valuables, Firearms, and Prohibited Items #

The customer is solely responsible for all personal property left in or on the vehicle. Eli's Elite Mobile Detailing is not responsible for loss, damage, misplacement, theft, disposal, or claims involving personal property, including cash, jewelry, cards, electronics, documents, firearms, tools, accessories, toll devices, garage openers, keys, medication, child seats, or sentimental items.

The company does not inventory the customer's belongings. Any items removed for cleaning may be placed in bags, containers, seats, cargo areas, or another reasonable location. The company may refuse to handle firearms, weapons, medication, illegal substances, biohazards, dangerous items, or anything it reasonably believes creates legal, safety, or liability risk.

Section 13

Zero Tolerance Drug and Controlled Substance Policy #

Eli's Elite Mobile Detailing maintains a strict zero-tolerance policy regarding illegal drugs, unlawfully possessed controlled substances, drug paraphernalia, and drug-related activity at or near any service location, vehicle, drop-off area, pickup area, or appointment.

  • If the company observes, smells, suspects, or reasonably believes that illegal drugs, unlawfully possessed controlled substances, or drug-related activity may be present, it may refuse to begin service, stop service, leave the job site, cancel the appointment, document the issue, and refuse future service.
  • The company will not touch, move, hide, dispose of, transport, or store suspected drugs, controlled substances, or drug paraphernalia.
  • Any deposit may be forfeited, payment remains due for work performed, and the company may charge reserved time, travel, setup, storage, and administrative costs to the extent permitted by law.
  • Lawfully prescribed medication is not prohibited when legally possessed, properly stored, and not creating a safety risk or interfering with service.
Section 14

Safety, Right to Refuse Service, and Job Site Conditions #

The company may refuse, pause, modify, or stop service at any time if it determines that the vehicle, customer conduct, job site, property, weather, lighting, traffic, animals, children, bystanders, substances, odors, pests, biohazards, electrical conditions, water conditions, parking location, or any other circumstance is unsafe, unlawful, unsuitable, or inconsistent with professional service.

If service is refused or stopped due to customer breach, unsafe conditions, prohibited items, lack of access, or conditions not disclosed before service, the deposit may be forfeited and payment remains due for work already performed, reserved time, travel, setup, and administrative costs to the extent permitted by law.

Section 15

Vehicle Condition Inspection and Photo Documentation #

The company may photograph, video, inspect, and document the vehicle before, during, and after service. Documentation may include exterior panels, interior areas, wheels, glass, trim, tires, stains, scratches, dents, chips, cracks, loose parts, prior repairs, paint readings, service notes, odometer, fuel/charge level, warning lights, keys, and work areas.

These records may be used for customer communication, quality control, training, insurance, dispute resolution, marketing, before-and-after content, and business records. The customer agrees that documentation is evidence of visible condition at the time recorded.

Section 16

Paint, Exterior Surfaces, Trim, Wraps, PPF, and Coatings #

Exterior detailing may reveal existing damage or weaknesses that were hidden by dirt, oxidation, contamination, wax, glaze, fillers, or poor lighting. The company is not responsible for pre-existing damage, failing clear coat, oxidation, rust, stone chips, scratches, dents, prior bodywork, thin paint, repaint issues, adhesive residue, failing trim, brittle plastics, loose badges, failing wraps, failing PPF, failing tint, aftermarket accessories, or defects not caused by the company's negligence.

Paint correction, polishing, compounding, decontamination, ceramic coating preparation, water spot removal, and adhesive removal involve reasonable professional processes but may carry risk on aged, repainted, thin, defective, oxidized, or previously damaged surfaces. The customer understands that not every scratch, stain, etching, chip, defect, or water spot can be safely removed.

Section 17

Interior Materials, Electronics, Screens, and Upholstery #

Interior cleaning may expose wear, stains, dye transfer, cracking, fading, discoloration, weak stitching, loose glue, sagging headliners, brittle plastics, aging leather, prior chemical damage, or prior repairs. The company is not responsible for pre-existing or latent issues that become visible during normal cleaning.

The customer understands that modern vehicles contain electronics, sensors, cameras, screens, buttons, modules, speakers, wiring, seat controls, heated/cooled seats, airbags, and other components. The company uses reasonable care around electronics and moisture-sensitive areas but is not responsible for issues caused by defective seals, prior water intrusion, damaged electronics, aftermarket wiring, low batteries, faulty components, or hidden defects.

Section 18

Water, Moisture, Pressure, Steam, and Chemical Disclaimer #

Detailing may involve water, pressure washing, steam, compressed air, extractors, vacuums, brushes, towels, chemicals, dressings, conditioners, protectants, degreasers, acids, alkaline cleaners, solvents, odor treatments, ozone or odor procedures, and other professional tools and products. The company selects methods based on professional judgment and the service requested.

The company is not responsible for damage or failure caused by pre-existing defects, poor seals, leaks, aftermarket parts, failing paint, loose trim, cracked glass, damaged weatherstripping, defective electronics, weak adhesives, worn materials, prior chemical exposure, hidden contamination, or customer-provided instructions that increase risk.

Section 19

Child Seats, Car Seats, and Installed Accessories #

The company does not reinstall, certify, adjust, or confirm the safety of child seats, booster seats, restraint systems, aftermarket electronics, dash cameras, radar detectors, phone mounts, work equipment, medical equipment, pet barriers, roof racks, bed covers, tool boxes, or other installed accessories. If such items are moved for cleaning, the customer is responsible for reinstalling and verifying them before use.

Section 20

Biohazards, Severe Conditions, Odors, Mold, and Infestations #

Vehicles with bodily fluids, vomit, urine, feces, blood, mold, mildew, pests, insects, rodents, needles, sharps, strong odors, smoke contamination, chemical spills, food rot, sewage, or unknown substances may require special handling, additional fees, limited scope, or refusal of service. The company is not a biohazard remediation company unless specifically agreed in writing.

Odor removal is never guaranteed. Odors can return from vents, carpet padding, foam, insulation, headliners, seats, leaks, smoke contamination, mold sources, cabin filters, HVAC systems, spills, or unseen areas.

Section 21

Monthly Maintenance and Subscription Services #

If the customer enrolls in a monthly maintenance, private client, fleet, or subscription program, the customer agrees that billing is upfront and recurring on the billing date selected or assigned. Subscription billing is payment for reserved access, schedule capacity, and the agreed maintenance visit frequency. It is not based solely on whether the customer uses the visit in a particular month.

  • No-shows, locked vehicles, unavailable vehicles, unsafe conditions, customer cancellation, or failure to provide access may result in forfeiture of that month's service without refund or rollover.
  • Weather or company-directed rescheduling does not pause or move the billing date unless the company agrees in writing.
  • Customer must keep a valid card on file and agrees that failed payments may pause scheduling, cancel benefits, or terminate membership.
  • Maintenance service is designed to maintain a previously detailed vehicle. Excessive dirt, stains, spills, pet hair, sand, mud, biohazards, or condition outside normal maintenance may require an upgrade or additional fee.
  • Cancellation requests must be submitted in writing before the next billing date. The company may require outstanding balances to be paid before cancellation is complete.
Section 22

Satisfaction Guarantee and Missed Areas #

Eli's Elite Mobile Detailing stands behind its workmanship. If the customer believes a visible area included in the purchased service was missed, the customer must notify the company within five (5) days of completion and provide clear photos. Valid concerns will be reviewed and, when appropriate, addressed within reason at no additional charge.

This guarantee does not cover new dirt, weather, use after service, defects not included in the purchased package, stains or damage that could not be safely removed, unrealistic expectations, third-party work, customer-requested limitations, failure to follow care instructions, or issues reported after the five-day period.

Section 23

Damage Claims, Inspection, and Limitation of Responsibility #

The company performs services with care, professionalism, and respect for every vehicle. If damage occurs as a direct result of the company's negligence during the performance of services, the company will take responsibility for the reasonable cost of repair or restoration of the affected area.

  • Customer must notify the company promptly, provide clear photos and supporting information, and allow the company a reasonable opportunity to inspect, document, and remedy the issue before third-party repair work is started.
  • The company may use before photos, after photos, video, inspection notes, service documentation, customer communications, and third-party information to determine responsibility.
  • Responsibility is limited to the reasonable cost necessary to restore the directly affected area and does not include unrelated improvements, upgrades, betterment, diminished value, loss of use, lost profits, rental vehicles, inconvenience, emotional distress, or consequential damages to the extent permitted by law.
  • The company is not responsible for pre-existing damage, normal wear, hidden defects, prior repairs, aftermarket modifications, mechanical failures, electrical failures, or damage discovered after the vehicle leaves the service area unless promptly reported and clearly connected to the service.
Section 24

Customer Instructions, Approvals, and Declined Recommendations #

The customer may provide instructions or preferences, but the company may refuse instructions that are unsafe, unprofessional, unlawful, likely to damage the vehicle, outside the booked service, or inconsistent with best practices. If the customer requests a method, product, shortcut, skipped step, or limitation against the company's recommendation, the customer accepts the risk associated with that instruction.

Section 25

Photography, Video, Marketing, and Privacy #

Customer grants permission for the company to photograph and record the vehicle for documentation, quality control, training, insurance, internal records, and marketing. The company may use before-and-after photos, vehicle images, service videos, and general project content on its website, social media, ads, printed materials, and portfolio unless the customer requests in writing before service that identifiable images not be used for marketing.

The company will make reasonable efforts not to intentionally display sensitive personal information, addresses, documents, faces, or license plates in marketing materials when practical.

Section 26

Communications Consent #

The customer consents to receive calls, texts, emails, invoices, quotes, appointment reminders, review requests, care instructions, subscription notices, payment notices, and service-related communications from Eli's Elite Mobile Detailing. Message and data rates may apply. The customer may opt out of marketing texts where required by law, but service-related communications may still be necessary to complete appointments.

Section 27

Chargebacks and Payment Disputes #

The customer agrees to contact Eli's Elite Mobile Detailing in good faith before initiating a chargeback or payment dispute. Improper disputes, false claims, payment reversals, or chargebacks for completed or properly reserved services may result in recovery of disputed amounts, chargeback fees, processing fees, administrative costs, collection costs, attorney fees, and refusal of future service to the extent permitted by law.

Section 28

Indemnification, Defense, and Hold Harmless #

To the maximum extent permitted by law, the customer agrees to defend, indemnify, and hold harmless Eli's Elite Mobile Detailing, Eli's Elite Detailing LLC, its owner, employees, contractors, agents, successors, and assigns from and against third-party claims, demands, actions, liabilities, damages, judgments, fines, penalties, losses, costs, and expenses, including reasonable attorney fees and costs, arising out of or related to any of the following, except to the extent finally determined by a court of competent jurisdiction to have been caused by the company's gross negligence, wantonness, or willful misconduct:

  • False, incomplete, inaccurate, or misleading information provided by the customer.
  • Customer instructions, approvals, refusals, or limitations related to service methods, chemicals, areas to service, or areas not to service.
  • Pre-existing damage, hidden defects, prior repairs, aftermarket modifications, failed components, or vehicle conditions not caused by the company.
  • Unsafe, illegal, or unsuitable service locations, including traffic exposure, unstable ground, poor lighting, water or electrical hazards, animals, children, bystanders, or third-party interference.
  • Personal property left in or on the vehicle, including claims by third parties alleging ownership or loss.
  • Customer negligence, misconduct, unlawful activity, breach of this agreement, failure to disclose hazards, or lack of authority to authorize service.
  • Claims by spouses, co-owners, lienholders, employers, leasing companies, fleet owners, or other third parties related to authorization, access, movement, transport, storage, or service of the vehicle.

If a claim potentially subject to this section is brought, the customer must cooperate with the company's investigation and defense, provide relevant information and documents reasonably requested, and reimburse covered defense costs as incurred to the extent permitted by law. This section survives completion of services, payment, cancellation, and termination of the parties' relationship.

Section 29

Limitation of Liability #

To the maximum extent permitted by law, the company's liability for any claim arising from or related to services, scheduling, access, storage, transport, payment, or this agreement is limited to the amount paid by the customer for the specific service giving rise to the claim, except for direct physical damage caused by the company's negligence as described in this agreement. The company is not liable for indirect, incidental, special, punitive, consequential, loss-of-use, diminished-value, lost-profit, or inconvenience damages to the extent permitted by law.

Section 30

Governing Law, Venue, and Dispute Resolution #

This agreement is governed by the laws of the State of Alabama, without regard to conflict-of-law rules. Any dispute arising from or related to this agreement, services, payment, vehicle access, storage, transport, or release shall be handled in the State of Alabama in a court or forum with proper jurisdiction and venue, unless the parties agree otherwise in writing.

Before filing a lawsuit, the parties agree to make a good-faith effort to resolve disputes directly. This does not prevent either party from seeking immediate legal relief where necessary to protect property, collect unpaid amounts, preserve evidence, or comply with law.

Section 31

Entire Agreement, Changes, Severability, and Survival #

This agreement, together with any written quote, invoice, package description, subscription agreement, or signed addendum, forms the entire agreement between the customer and Eli's Elite Mobile Detailing for the services provided. If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision shall be enforced to the maximum extent permitted by law.

The company may update its terms from time to time. The terms in effect at the time of booking or the terms signed by the customer control that appointment unless a later written agreement applies. Provisions related to payment, collections, damage claims, documentation, indemnification, limitation of liability, governing law, and dispute resolution survive completion, cancellation, and termination.

Section 32

Electronic Signatures and Counterparts #

This agreement may be signed physically or electronically. Electronic signatures, typed names, checked boxes, emailed approvals, text approvals, invoice approvals, and other electronic confirmations are intended to have the same effect as handwritten signatures to the extent permitted by law. Copies, scans, photos, and electronic versions of this agreement may be used as originals.
